Schedule 3: Legislation Amended

  1. Sections 31 and 32 of, and Schedule 5 to, the Municipal Structures Act are hereby repealed.
  2. Section 27 of the Municipal Structures Act is hereby amended by the substitution for paragraph (d) of the following paragraph:
    "(d) contravenes a provision of the Code of Conduct for Councillors set out in Schedule (5) of the Local Government: Municipal Systems Act, 2000, and is removed from office in terms of the Code".
  3. Section 81 of the Municipal Structures Act is hereby amended by the substitution for subsection (5) of the following subsection:
    "(5) When participating in the proceedings of a municipal council a traditional leader is subject to the appropriate provisions of the Code of Conduct set out in Schedule (5) of the Local Government: Municipal Systems Act, 2000".
  4. Section 82 of the Municipal Structures Act is hereby amended by the addition of’ the following subsection, the existing section becoming subsection (1):
    "(2) A person appointed as municipal manager must have the relevant skills and expertise to perform the duties associated with that post".
  5. Schedule 4 of the Public Finance Management Act, 1999 (Act No. 1 of 1999), is hereby amended by the addition of the following item:
    "(2) Fines and estreated bails paid in respect of’ offences and alleged to offences in terms of-
    1. by-laws enacted by municipalities; or
    2. national or provincial legislation, the administration of which is assigned to municipalities".
